QUICK FACTS ABOUT PROBATE

Probate refers to the process where a court oversees the administration of a deceased person’s estate. The purpose of the probate process is to ensure that any final bills and expenses are paid, including any taxes owed, and any remaining assets are distributed to the beneficiaries named in a will, or if there is no will, in accordance with California law.
If a person dies and the property was not transferred to heirs by means of a trust, joint ownership with a right of survivor-ship, or a direct payment such as insurance policies and retirement accounts, it may be necessary to probate a will. It is highly recommended that you contact a probate attorney to help you through this process.

The primary disadvantage of probate is the cost; followed closely by the time delay and lack of privacy associated with probate administration. Many clients desire to avoid probate altogether. This can be done with careful estate planning. Tools such as a properly funded revocable living trust can help to bypass the requirement of probate administration. We can help with that!

Estate planning is the act of preparing for the transfer of a person’s wealth and assets after his or her death. Assets, life insurance, pensions, real estate, cars, personal belongings, and debts are all part of one’s estate. We can help you protect your assets and your beneficiaries avoid the complications of probate down the road.

About David Brown

David Brown

Attorney Brown has had a variety of assignments since 1996, when he graduated from law school. He was an attorney for Wells Fargo Bank, a Prosecutor, and an Associate for our office. In 2006 he became a senior partner and owner at Beyer, Brown & Rosen (BBR). Dave’s attraction to the subject of law, and his reason for going to law school, is and was to help people in need.

During his employment at BBR he has handled trial after trial, ranging from contract disputes to family law issues to the heaviest felonies. Little by little, his interest shifted to Probate and Trust matters, until today his focus is primarily Trust and Estate work, including all phases of Probate litigation.

He also works with Asset Protection matters, such as business entities and partnership creation. He remains our senior trial attorney and continues to dedicate his career to helping those in need.
